So, for years, we’ve heard in our office from people who’ve just arrived in the country and are in some kind of immigration process, perhaps applying for asylum, or parole, or different ways of applying for immigration status. Now their children have Medicaid.

Now they have Medicaid, and we do, okay, but why do they have Medicaid if you’re literally not eligible for Medicaid? It’s not like someone helped me and now I have Medicaid. So, that’s what’s being put in place.

A lot of federal funds are being invested in these people who don’t really qualify, but there are many options. I mean, Medicaid isn’t the only option for us to have health coverage; there are many options. So, what they’re doing is, okay, they announced, we’re going to review, and all these people who applied and don’t qualify will be left without coverage.

Carlos: Could the government really take away these people’s coverage and also affect their immigration status?

Yenniree: Definitely yes. What was announced is that they will review it. The moment they look at the form or María Pérez’s case and realize that María Pérez isn’t a permanent resident or a citizen, that family will automatically lose coverage.

It’s not something that can happen. No, the order is already in place. They’re going to review all cases, and those who don’t qualify based on immigration status will have their Medicaid benefits taken away.

What can affect immigration status? Carlos: So, if the Medicaid rules establish—and they’re not new rules, they’ve always existed—that to qualify for Medicaid, you have to be a resident or citizen. How is it that so many people without this immigration status have been able to access Medicaid?

Yenniree: Often, due to misinformation, people don’t even know that a person arriving in this country doesn’t know that they have to be a resident or a citizen to obtain this benefit, and many people help them fill out the online application. There’s a question that asks if they’re a resident or not, and people answer yes, and there’s simply no further review, and the person receives the benefit. But other times, apart from misinformation, it’s because the question isn’t clear. As I mentioned earlier, living in the United States for a certain amount of time doesn’t make us residents.

So, they think, OK, I’ll put “yes” because I’ve lived here for 10 years, or for a month, or however long it is. So, many times people help them, they don’t realize it, or they just do it because, well, yes, let’s put “yes” so they’ll get the benefit. But what they’re actually doing is harming the person because they’re not supposed to get this Medicaid benefit.

So, you have to be very careful, you have to be informed before taking any step like this, because at the end of the day, it’s federal funds we’re using. Medicaid, Food Stamp, all of those things are federal funds we’re using, and if we don’t have the status we need to apply for, then it’s best not to have it.
